Terms & Conditions

These Terms & Conditions (the "Terms") govern access to and use of the Venurez.com platform and related services provided by Buraptech, a trademark of BURAP YAZILIM DANIŞMANLIK TEKNOLOJİ ANONİM ŞİRKETİ ("Buraptech", "we", "us", or "our"). By creating an account, browsing venues, or completing bookings you agree to be legally bound by these Terms. If you do not agree, do not use the Services. Buraptech is established in Izmir, Turkey and operates subject to the mandatory laws of England and Wales and the Republic of Turkey. These Terms are drafted in English; translations are provided for convenience.

2. Eligibility and Account Responsibilities

Users must be at least 18 years old and have legal capacity under applicable law. You are responsible for the accuracy of information provided, safeguarding credentials, and promptly notifying us of unauthorised use. We may suspend or terminate accounts that violate these Terms, applicable law, or pose security risks.

3. Service Scope

Venurez.com provides a marketplace where Hosts list venues and Guests arrange bookings. Unless expressly stated, Buraptech is not a party to the Booking contract between Host and Guest. We provide platform services, customer support, dispute facilitation, and payment infrastructure. Hosts remain responsible for venue compliance, licensing, tax obligations, insurance, and onsite conduct. Disputes between Hosts and Guests will first be escalated through the Venurez support team; if unresolved, parties retain the right to pursue legal remedies in the competent courts.

4. Host Obligations

Hosts must ensure venue descriptions are truthful, maintain required permits, adhere to health and safety laws, obtain consents for data collection (such as CCTV), and honour confirmed bookings. Hosts must connect a valid payout account through our Payment Partners before accepting bookings. Hosts are solely responsible for including taxes in their pricing and issuing invoices where mandated. Buraptech does not provide insurance or act as an insurer and is not responsible for repairing or reimbursing losses arising at a venue.

5. Guest Obligations

Guests must provide accurate attendee information, comply with venue rules, respect capacity limits, and ensure their activities are lawful. Guests are liable for damages they or their invitees cause. Guests must not arrange off-platform bookings with Hosts derived from the Services without prior written consent from Buraptech.

6. Booking Process and Cancellations

Bookings become binding when the Guest receives a confirmation notice. Cancellation and refund entitlements are governed by the policy displayed at the time of booking and any applicable mandatory consumer rights. Buraptech reserves the right to cancel bookings for fraud prevention, safety concerns, or legal compliance. In such cases we will provide prompt notice and, where possible, assist with alternative arrangements.

7. Fees and Payment

Buraptech charges platform fees (service fees) to facilitate bookings between Guests and Hosts. Platform fees cover transaction processing, payment handling, fraud prevention, customer support, and platform maintenance. Platform fees are charged at the time of booking and are non-refundable, regardless of cancellation, unless legally required or at the sole discretion of platform administrators.

Payment processing is provided by authorised Payment Partners (Stripe). When a Guest completes payment, funds are held securely on the platform until the booking's refund window expires according to the Host's cancellation policy. Once the refund period has passed, the booking amount (minus platform fees and applicable charges) is transferred to the Host's connected account. This ensures Guests have full access to refunds during the cancellation window without requiring retrieval of funds from Host accounts.

Charges may be denominated in multiple currencies and subject to exchange or conversion costs. Hosts authorise Buraptech and its Payment Partners to deduct platform fees and applicable taxes from payouts. Guests authorise charges to their selected payment method for bookings, add-ons, damages, or penalties permitted under these Terms. Foreign exchange conversion rates are determined by the relevant Payment Partner and fall outside Buraptech's control.

Refund Policy: Cancellation refunds apply only to the booking amount (venue cost), excluding platform fees. The refund percentage depends on when cancellation occurs relative to the booking start time and the Host's selected cancellation policy (Flexible, Moderate, or Strict). Platform fees are retained to cover costs already incurred in processing the booking.

8. Taxes and Reporting

Hosts are responsible for determining and remitting any VAT, GST, withholding tax, or municipal levies. In jurisdictions where Buraptech is legally required to collect or remit taxes, we may withhold amounts from payouts or require additional documentation. Hosts authorise us to issue tax invoices or receipts in their name when local legislation permits.

9. Compliance with Law

Users must comply with all applicable laws, including fire and safety regulations, consumer protection, public order, alcohol licensing, music licensing, and data protection. Hosts must ensure venues are accessible and safe in accordance with relevant UK or Turkish standards. Guests must secure any permits required for their events.

10. Intellectual Property

Buraptech retains all intellectual property rights in the Services, including trademarks, software, design, and content. "Buraptech" is a trademark of BURAP YAZILIM DANIŞMANLIK TEKNOLOJİ ANONİM ŞİRKETİ. Users receive a limited, revocable licence to use the Services for their internal business purposes. Hosts grant Buraptech a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote listings.

11. Acceptable Use

Users must not: (a) engage in fraudulent, defamatory, or abusive conduct; (b) attempt to circumvent platform security; (c) use the Services for unlawful events; (d) upload malicious code; (e) copy or reverse engineer the Services; or (f) harvest user data without consent. We may investigate and cooperate with authorities on suspected violations.

12. Data Protection

Buraptech processes personal data in accordance with its Privacy Policy. Hosts and Guests are independent controllers of any personal data they exchange outside the platform (for example attendee lists). Users must comply with the UK Data Protection Laws, the KVKK, and any other applicable privacy regulations when handling personal data obtained through the Services.

13. Third-Party Services

The Services may link to or integrate third-party tools. Buraptech is not responsible for these tools and does not endorse them. Use of third-party services is at your own risk and may be subject to additional terms and privacy notices imposed by the provider.

14. Suspension and Termination

We may suspend or terminate access without notice if we reasonably believe a user has breached these Terms, applicable law, payment obligations, or acted in a manner that could harm Buraptech, other users, or the public. Users may terminate their account at any time, subject to outstanding bookings, fees, or legal obligations. Buraptech also reserves the right to edit or remove listings containing misleading, unlawful, or inappropriate content without prior notice.

15. Disclaimers

The Services are provided on an "as is" basis. We do not warrant uninterrupted availability, error-free operation, or suitability for a particular purpose. While we vet Hosts on a risk basis, we do not independently verify every Host's identity or confirm ownership of each venue, and users should conduct their own due diligence before relying on any listing. Venue descriptions are supplied directly by Hosts and Buraptech does not guarantee their accuracy. Statutory rights that cannot be excluded under UK or Turkish law remain unaffected.

16. Liability

To the maximum extent permitted by law, Buraptech is not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, business interruption, anticipated savings, goodwill, or data. Our total liability arising from the Services will not exceed the aggregate fees paid by you during the twelve (12) months preceding the event giving rise to the claim. Nothing limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under law.

17. Indemnity

Users agree to indemnify and hold harmless Buraptech, its directors, employees, and affiliates from claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising out of: (a) breach of these Terms; (b) violation of law or third-party rights; (c) misuse of the Services; or (d) disputes between Hosts and Guests.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales when the dispute involves UK-based services or users, and by the laws of the Republic of Turkey when the dispute involves Turkey-based services or users. Each party submits to the exclusive jurisdiction of the courts of London, England, or Izmir, Turkey as applicable. Where consumer protection law provides mandatory alternative forums, those rights prevail. We encourage parties to work with our support team before commencing proceedings.

19. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government orders, pandemics, labour disputes, or infrastructure outages.

20. Changes to These Terms

We may revise these Terms to reflect changes in law or the Services. Material changes will be notified through the platform. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
